In the 1990s, U.S. National Security Agency official Thomas Bryan Reynolds (Jon Voight) meets with congressman Phil Hammersley (R-NY) (Jason Robards) in a public park to discuss support for new counter-terrorism legislation the U.S. Congress is pushing that dramatically expands the surveillance powers of intelligence agencies on individuals and groups. Hammersley remains committed to blocking its passage, since he believes it would almost totally destroy the privacy of American citizens. Reynolds has his team murder Hammersley, spread heart pills over his car, place him in the car and push it in a lake to make it look like he had a heart attack. In the aftermath, they discover too late that wildlife researcher Daniel Zavits (Jason Lee) had a camera aimed in the woods at their location. Zavits inspects the footage, transfers the video to an innocuous video game disc and flees the apartment ahead of Reynolds's team.

The film opens in 1968 at St. Anne's Academy, a California Roman Catholic school, where a young girl named Deloris Wilson is scolded by Sister Immaculata (Lois de Banzie) for wisecracking and disobedience. The setting then changes to the present day, where Deloris Van Cartier is a lounge singer in a 1960s-themed act called The Ronelles (a parody of The Ronettes), who sing at The Moonlite Lounge of the Nevada Club in Reno, Nevada, run by her boyfriend, the mobster Vince LaRocca. After Deloris walks in on Vince having his chauffeur Ernie executed for betrayal, Vince orders his two henchmen Joey and Willy to kill her as well. Deloris flees Vince's casino to the local police station where Lieutenant Eddie Souther suggests she testify against Vince if he can be arrested and tried, but for now, she should go into witness protection until the time comes.

Along with Poe are several other prisoners including his diabetic cellmate and friend Mike "Baby-O" O'Dell, who is being transferred (but not yet paroled) with Poe. The transfer is being overseen by U.S. Marshal Vince Larkin, as the transfer includes notorious criminal mastermind Cyrus "Cyrus The Virus" Grissom, gangster and Black Guerrilla member Nathan "Diamond Dog" Jones and mass murderer William "Billy Bedlam" Bedford for their transfer to a new Supermax prison. Larkin is approached at the last minute by DEA agents Duncan Malloy and Willie Sims, who ask for Sims to be brought aboard disguised as a prisoner so that he can extract more information from drug lord Francisco Cindino, a prisoner that is to be picked up at Carson City, Nevada en route. Larkin agrees, unaware that Malloy has hidden a gun on Sims' body.
