The Exonerated is a made-for-cable television film which dramatizes the true stories of six people who had been wrongfully convicted of murder and other offenses, placed on death row, and later exonerated and freed after serving varying years in prison. It was based on a successful stage play of the same name written by Erik Jensen and Jessica Blank and first aired on the former CourtTV cable television network on January 27, 2005. It is directed by Bob Balaban was produced by Radical Media.

Actors played the roles of the five men and one woman. It stars David Brown, Jr. (the only cast member to have appeared in the stage play) as Robert Earl Hayes, Brian Dennehy as Gary Gauger, Danny Glover as David Keaton, Delroy Lindo as Delbert Tibbs, Aidan Quinn as Kerry Max Cook and Susan Sarandon as Sonia "Sunny" Jacobs.

The script was based on the exonerees' personal experiences as well as court records and media accounts.

Jessica Blank, who is married to Erik Jensen, got the idea for the play when she moved from Minneapolis, Minnesota to New York City. She and Jensen attended a conference about the death penalty and listened to stories about wrongful convictions and confessions gained via torture, threats and deception. The couple spent the summer of 2000 interviewing exonerees throughout the United States and adapted the stories of six people into a script.

The play was first presented in New York City; the final performance was in Minneapolis in 2002.

For their efforts, Jensen and Blank received the Champion of Justice Award from the National Association of Criminal Defense Lawyers. [1]

Lara Brennan (Elizabeth Banks) is convicted of murdering her boss and is sentenced to life in prison. In 1987, Doris Duke, considered the wealthiest woman in the world, hires Bernard Lafferty, who lists Elizabeth Taylor and Peggy Lee as former employers on his résumé, as her majordomo. He explains a six-month gap in his employment history was due to "health issues," a euphemism for time spent in rehab to deal with his addiction to alcohol. He assures Doris, who immediately suspects the truth, he is capable of performing his duties without any problems. As Bernard moves in, the viewer can quickly tell he is a little neurotic, first putting portraits of his former employers, Taylor and Lee, in his bedroom, then informing the rest of the staff he is now "Miss Duke's eyes and ears" and demanding they listen to him. Despite Bernard's growing affection for Doris, the brash and often crude Doris thinks little of him, not even remembering how to correctly pronounce his name. However, their situation slowly evolves into a more emotionally intimate but non-physical relationship as Doris returns from a plastic surgery center one evening, drunk and on painkillers, and is aided by Bernard who stays with her through the night.

The film, although based on fact, is a stylized retelling of the events of August 4, 1892 when the father and step-mother of New England spinster Lizzie Andrew Borden were found brutally murdered in their Fall River, Massachusetts home. The subsequent incarceration of the prime suspect (Lizzie herself) as well as the coroner's inquest and trial are largely faithfully depicted, using actual testimony. In what may be seen as deviation from the film's docudrama narrative, as Lizzie hears her verdict, flashbacks are shown of her actually committing the murders in the nude and bathing after each death, thus explaining why no blood was ever found on her or her clothes; however, it is left ambiguous whether Lizzie was actually reminiscing about the crimes or simply fantasizing how she herself would have disposed of her victims. The film ends after Lizzie's acquittal with Lizzie's sister Emma asking her point-blank if she killed their parents; Lizzie does not answer. The epilogue states that the killings of Andrew and Abby Borden remained unsolved.
