Unconstitutional: The War on Our Civil Liberties is an American 2004 political documentary about the legal problems with the PATRIOT Act. It posits that the law, hastily passed in the wake of the 9/11 attacks, is used to justify a variety of abuses of civil rights that are guaranteed by the US Constitution.

This third and final film in the Un-trilogy from Executive Producer Robert Greenwald and Earl Katz, is a Public Interest Pictures Film. Unconstitutional was written, produced and directed by Nonny de la Peña.

Synopsis

A few weeks after the September 11 attacks in 2001, the United States Congress passed a complicated and controversial law purportedly designed to help with tracking future terrorist threats. Unconstitutional's purpose is to explain the USA PATRIOT Act to its viewers and expose its alleged failings.

The film starts with the events of March 2004 in Fallujah, where four Blackwater contractors were ambushed, set afire, their burned corpses dragged through the streets and then finally displayed hanging from a bridge. In interviews, two of the contractors’ families contend that Blackwater, in search of higher profit, neglected to provide proper support and protection to their employees, including maps, decent translators, an armored vehicle, and sufficient security personnel (their convoy was short a machine gunner). The families contend that with such support, their loved ones might be alive today.
